Raphael Holiday was Put to Death, and His Lawyers Should Have Tried Harder to Stop It By Gretchen Sween

Gretchen Sween was hired a month before Holiday was executed. This is what she saw. 

  On Nov. 18, 2015, at about 8:30 p.m., the state of Texas declared Raphael Holiday dead while I sat alone sobbing in a parked car. He was executed for the deaths of three children, including his own, in a house fire.I am a civil litigator in private practice. I began representing Raphael a month before his execution, after his lawyers sent a letter informing him: “This marks the end of work for your appeals I regret.” The letter acknowledged the option to submit “a clemency petition to the Texas governor,” but they did not recommend that because, in their view, “a clemency petition just gives an inmate false hopes.” 






Although the letter made clear that his lawyers were “not going to file further appeals for you,” it also stated that Raphael was free to write to law firms or public interest organizations to see if he could find someone else willing to take on his case. The lawyers even promised to cooperate and provide his file if he could find anyone to do the work.So Raphael sent out desperate letters from death row — to lawyers as far away as California — trying to find someone willing to help him.Meanwhile, in August, Texas set an execution date.Because his efforts to obtain new lawyers on his own had failed, Raphael wrote the following to the court on Sept. 14: “Your honor, I beg you to consider new appointment of effective counsels to my case. They have refused to help me and it is a disheartening conundrum I am not fit to comprehend.” His lawyers filed a response, opposing their client’s request. Facts of Case
·         At 18 years of age Raphael Holiday entered a sexual relationship with a 24 year old white woman whose name is Tammy.
·         It was later determined that Tammy was sexually involved with 4 other men in addition to Raphael.
·         Some of those men were convicted sex offenders who spent time around her children.
·         Tammy took 3 days to get her seven year old daughter to a doctor after she was molested.
·         Tammy lied and accused Raphael of molesting the child.  CPS Employee Rhonda Harris cleared him of molestation, he was never charged or indicted.
·         Raphael states that Tammy’s parents used racial names toward him.

·         Tammy’s mother supposedly collected a large sum of cash from children’s Wrongful Death Insurance Policies.
·         The attorney representing Raphael in lower court trial attended high school with Tammy’s mother.
·         The Appellate attorneys turned against Raphael in efforts to cover up their negligence.
·         Lawyers lied and stated that Raphael was charged and indicted of molesting a 7 year old child.  This is untrue. Raphael was cleared of molesting the child by CPS Employee Rhonda Harris.

Urgent Call To Action For Raphael Holiday - The State Of Texas

Raphael Holiday faces a November 18, 2015 execution date while being represented by two lawyers that botched his appeals, turned on him and want to see him executed. Raphael's execution would cover up their legal mistakes and breach of fiduciary duties.  Raphael tried to get the lawyers removed from his case at one point however; they refused to leave. Now, they want to leave but, the judge will not allow them to leave the case.

The lawyers have breached fiduciary duties, committed negligence, breached their contracts and caused overall harm to Raphael. That harm has resulted in a date for execution.

There are many pertinent issues which MUST be professionally investigated.  Those issues would prove that Raphael is Innocent of Capital Murder. A few of those facts and issues are below.
